Terms of service

These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with www.moyang.eu operated by Moyang (“us”, “we”, or “our”).

Your access to, and use of our website www.moyang.eu is conditioned on your acceptance of, and compliance with these terms. These terms apply to all visitors, users and others who access or use our website www.moyang.eu.

PURCHASES

If you wish to purchase any product or service made available through our website www.moyang.eu (“Purchase”), you may be asked to supply certain information relevant to your purchase including - without limitation - your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any purchase; and that (ii) the information you supply to us is true, correct and complete.

By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of purchases.

PAYMENTS

We accept the following payment methods: iDeal or bank transfer. We reserve the right not to accept certain payment methods for a given order and to refer to other payment methods. Please note that we only accept payments from accounts within the European Union (EU). You are responsible for any costs associated with money transactions and currency exchanges.

The legal payment term for invoices is 30 days from the date you place an order. Please make sure to pay in time. We reserve the right to charge a late payment fee of a maximum of 15% on orders below €2.500, 10% on the next €2.500, and 5% on the next €5.000 with a minimum of €40. You have the right to bring evidence to show that the actual damage sustained was substantially less than the fixed fee, or that no damage was sustained at all. You consent to receiving invoices and credits solely in electronic form.

SHIPPING

We send your order as soon as we have received your payment. Moyang promises to do everything in its power to deliver your ordered items as soon as possible. On average, orders are delivered within 5 working days. We will inform you on status updates of your order. If you have not received your order after 10 days, please contact us by emailing info@moyang.eu

Free shipping is offered from purchases above €150. Next to at-home delivery, we offer the option to pick up your order at one of our offices.

Moyang offers delivery to countries within the EU only. If you wish to deliver your order to a country outside of the EU, please contact us at info@moyang.eu. Do note that extra shipping & VAT costs may apply.

RETURNS

Return process

Check your received package for any damage or faults and let us know by email.
Return the items within 14 days after receiving the order.
Do NOT take off the hygiene sticker. Goods must be returned in their original condition. Returned items include their tags and hygiene sticker and must be unwashed, unworn and unaltered in any way.
Returning costs are at your expense. If you would like to change your items for a different colour or size, return your unwanted item and place a new order.
Please use a traceable or insured method such as a recorded delivery. We do not refund items that have gotten lost.
The money of your purchase will be refunded as soon as possible after receiving your return (with a maximum of 14 days). We will always refund the money to the same account as which you paid with unless specified otherwise.
We reserve the right to refuse refunds on any items where the hygiene sticker and/or tag has been removed or where we believe to have been worn or damaged since dispatched from webshop.

ORDER CANCELLATION

You have the right to cancel your contract with us within 14 days without giving any reasons. The cancellation period will expire 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires possession of the last item in your order.

To exercise the statutory right to cancel you must inform us by sending an email to info@moyang.eu. Please attach your invoice to the email and specify what you want to cancel.

You must return the items you no longer want to us without undue delay, and in any event not later than 14 days from the day on which you told us you were cancelling the contract. You will be required to pay the return shipping costs.

We shall refund to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we received the returned items. We will carry out such refund using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. You are only obliged to cover any depreciation in the value of returned items if the depreciation is attributable to your improper handling of the returned items when examining their condition, properties and function.

ORDER REVOCATION

You have the right to cancel your order within 24 hours by sending an email to info@moyang.eu. We will refund you within 14 working days.

PRIVACY POLICY

Moyang respects the privacy rights of its online visitors and recognizes the importance of protecting the information collected about them. We have adopted a corporate wide Privacy policy that guides how we collect, store and use the information that you provide us with. If you are under 18, we require that you inform a parent or guardian about the Moyang Privacy policy and Terms and conditions as well as requiring their consent to the Privacy policy and Terms and conditions before registering with Moyang or placing an order with Moyang. When you place an order or register for a service offered by Moyang, we collect personal information. When creating an account or placing an order we ask you for your first and last name, your email address and phone numbers, home address, shipping address and your date of birth. Next to this information, we also may gather the IP address you use to connect to our site. All of the details described above allow us to process your order and let you know the status of your order. Credit card details are entered directly into our payment partner’s systems and are neither transmitted nor held in our systems. Additionally we may also obtain information as a result of authentication or identity checks.

ACCOUNTS

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use our website only with involvement of a parent or guardian. Moyang and its associates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

AVAILABILITY, ERRORS AND INACCURACIES

We have made every effort to display the colors and images of our products as accurately as possible. We cannot guarantee that the display on your computer monitors the colors accurately.

All descriptions of products are subject to change at any time without notice, at the sole discretion of us.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

PRICING

All pricing is subject to change without prior notice. We reserve the right to adjust the price of any product sold through our website www.moyang.eu at any time at our sole discretion. In the event that a product is listed on our website www.moyang.eu at an incorrect price due to a typographical error or error in pricing information, Moyang will have the right to refuse or cancel any orders placed for the product listed at the incorrect price. Moyang will have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card has been charged. If your credit card has already been charged for the purchase and your order is cancelled, Moyang will make reasonable attempts to notify you and will issue a credit to your credit card account in the amount of the incorrect price.

The website and its original content, features and function are and will remain the exclusive property of Moyang and its licensors. The website is protected by copyright, trademark, and other legislations of both the Netherlands and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of Moyang.

Our website may contain links to third-party websites or services that are not owned or controlled by Moyang.

Moyang has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that Moyang will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

GOVERNING LAW & JURISDICTION

These terms shall be governed and construed in accordance with the laws of the Netherlands. Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights. If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect. These terms constitute the entire agreement between us regarding our website www.moyang.eu and supersede and replace any prior agreements we might have between us regarding the use of www.moyang.eu.

CHANGES

We reserve the right, at our sole discretion, to modify or replace these terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
